Just a quick update on this. I have been in contact with Thomas and we have been able to get it to work.
I am now able to do the flips and hit rescue afterwards without any issue.

We added calibration for Gyro sensor, which help to eliminate tolerances from manufacturing process.
After calibration precision can be improved noticeably. Fortunately it could be really needed only in rare cases, if so it is done once for unit.
So if precision is still not good after trying all options, this can be possibility.

So is this automatic or do we need a software update? I've had rescue towards the ground in the past but there was no solution.

This depends on when the problem was happening. If firmware 3.1 and newer was used, then there are new possibilities to resolve the problem.
If you tried to proceed according our guide with no improvement, then you can use this new solution. It will be available in the new update.

This is good news as my unit wants to throw heli into the goround sometimes after advanced manouvers too (running 3.2.1 firmware). Now I see that I'm not such a lonely case with this problem, people started to chiming in on this issue.
Looking forward to next firmware update!

Where can this gyro calibration settings be found ?
